Research On The Problems And Countermeasures Of The University Statutes Construction From The Perspective Of The Spirit Of Rule Of Law

The spirit of rule of law is the core of modern social law system,the statutes of the University is the university’s "constitution",provides the legal basis for university development,leading universities operate rationalization and rule of law.Therefore,the operation system of the spirit of rule of law——the spirit of advocating law,the spirit of the legislation,the spirit of law enforcement,the spirit of Justice——into the University Statutes construction,provides the theoretical basis and practical guidance for the construction of University Statutes,this is a very important and urgent research topic.The research method of this paper mainly adopts the literature method,comparative method and case analysis method on the related problems of University Statutes construction from the perspective of the spirit of rule of law and its countermeasures are analyzed and discussed.The thesis is mainly divided into three parts:The first part mainly expounds the spirit of rule of law and its program,analysis of the meaning,making subject,content structure of University Statute,the relationship between the spirit of the rule of law and the articles of association of the university are explained,this part is the foundation part of this paper, in order to pave the way for the following;The second part mainly from the main components of the spirit of the rule of law factors four dimensions,the spirit of advocating law,the spirit of the legislation,the spirit of law enforcement,the spirit of Justice on the existence of the University Statutes construction in existing problems and their causes are analyzed;The third part mainly discusses that the spirit of rule of law promotes the countermeasures and suggestions of the University Statutes construction,for the second part of the problems found and the reasons,put forward the corresponding solution from the spirit of rule of law in the constitution, the spirit of advocating law,the spirit of the legislation,the spirit of law enforcement,the spirit of justice four aspects,thus provides a new concept and method for the construction of University Statutes.
