| In order to transform government functions and create a service-oriented government, the Third Plenary Session of the 18th CPC Central Committee requirements to promote government procurement of services. The departments concerned have issued a number of notifications to ensure that government procurement of public services running in the law. However, China’s government procurement of public services is still a lack of legal basis. Whether the central or local government introduced policy documents are present low levels and operability weak. Practice has also exposed the government procurement of public services face many legal difficulties. Such as the scoping of purchase is unclear, Purchase process confusing, Regulatory imperfect, performance evaluation system is imperfect, and so on. These problems severely restrict our government procurement of public services development, and we need to address these issues through legislation. The paper’s perspective is the legal regulation, On the basis of summarizing existing problems, learning from the experience of United States, Britain, Germany, Japan and put forward a sound recommendations.Firstly, the first part is the basic theory.introduce the definition of government procurement of public services and the legal relations between subjects. Introduces the difference between related concepts and how to buy the public services.Secondly, introduce the experience of United States, Britain, Germany, Japan.Summed up the experiences in these country, and put forward a comprehensive recommendations.The third part introduces the current legislative conditions, and pointed out the legal difficulties in existing legislation, such as purchase range, purchasing procedures, information disclosure, supervision and so on.Finally, in view of the government purchase legal difficulties currently faced by public services, we put forward some recommendations. Including changes the law, develop power list, complete the purchase process,establish an independent regulatory agencies, clear assessment methods and so on, to look forward to helping our government procurement of public services regulation legal. |
