At present, China’s rural economy is facing transition from smallmarket to big market. From the current theoretical research and practical experience, theagricultural cooperatives is an effective organizational form to solve conflicts,"smallfarmers" and "big market" between channels is important to maintain the economic interestsof farmers, the main way is to help farmers reduce market risks. In recent years, agriculturalcooperatives in the rapid development of China’s vast countryside, to promote China’sagricultural industry, the scale of operations, increase farmers ’income, improve farmers’living standards played an important role for China to achieve modernization of agriculturehas laid a solid foundation. The rise and development of agricultural cooperatives in thecountry set off a legal theory of agricultural cooperatives Legal Issues boom. Our farmercooperatives refer to the same kind of agricultural producers or production operations servicesprovider, combining independent economic organizations, the organization is based in therural household contract basis. Farmer cooperatives now also being developed early, its legalsystem is imperfect affect farmers’ cooperatives fast, healthy run. The second chapter mainly introduces the overview of farmer specialized cooperatives inchina. Including the concept and characteristic of farmer specialized cooperatives, have aclear understanding of the farmers’ professional cooperatives; the similarities and differencesbetween the classification of farmer specialized cooperatives and other organizational forms,in order to more accurately grasp the essence of farmer specialized cooperatives; also theevolution and significance of farmers’ professional cooperatives, which have importantpractical meaning for now China’s rural economy and society in the future.The third chapter analyzes the legislation and operation status of farmer specializedcooperatives in china. Through the analysis on the present situation and problems oflegislation and operation, find professional farmers cooperatives in our country has manyproblems in practice, leading to the overall number between, the slow pace of development,the imbalance of regional development. And the defect of legal system led to the main bodystatus is not clear, the internal governance structure is not perfect and so on.The fourth chapter mainly reviews the professional farmers cooperatives in developedcountries and areas of the legislation and the reference. Based on the analysis of France, theUnited States, Japan, South Korea and China’s Taiwan region legislation, drawing lessonsfrom beneficial to our country’s actual development experience, to conducive to thedevelopment of farmer specialized cooperatives in China perfect.The fifth chapter is to perfect the system of farmer specialized cooperatives in china.Through the analysis on the problems in Chapter third and in developed areas of foreigncooperative legislation, put forward suggestions to perfect our country farmer specializedcooperative society main body system, membership right system, property and liabilitysystem, the internal governance structure system, to conducive to the development of farmerspecialized cooperatives in china.
