The Discussion Of Criminal Regulation Of Internet Rumors

In modern society, the popularity of the Internet to our lives has brought great convenience, but at the same time, the Internet is a "double-edged sword", which allows us to enjoy the convenience of life, but also gives us a series of questions. In recent years, with the rapid development of Internet technology, using the Internet for the growing number of criminal acts, such as:Internet rumor crime. Internet rumors refer that words which has no factual basis spread by internet media. Because of the spreading of internet rumors burst and fast, the normal social order caused great negative impact. The network is a virtual community. With the development of society, virtual community has been inextricably linked with the social reality. If spread rumors is allowed, it will definitely against the social mainstream values, intensified social conflicts, social harmony and stability. Internet rumor is the problem faced by governments around the world. The attitude of every country is consistent in terms of the network to crack down on rumor. Many countries have developed appropriate laws and regulations designed to fight against internet rumors. Similarly, Judicial interpretation has make provision for the crime. However, this explanation is not satisfactory. Some places are controversial. I hope this article can play a valuable analysis of the effect of criminal law in order to be able to conduct in-depth research on these controversial issues in order to better judicial practice to be implemented.This paper is divided into four parts altogether.Part â… :This section describes the main characteristics and dangers of Internet rumors. The network rumors characteristics are discussed briefly. As the dangers of Internet rumors, mostly from personal, social, national three aspects to elaborate, and analyzed in detail through some typical cases.Part â…¡:The first part of the proposed network rumors incriminating significance on the basis of the above dangers, and then make some charges of Criminal law.Part â…¢:This part is the focus of this article discusses. This part analyzes two typical charges briefly:libel and disturb the crime. The explanation after the introduction of interpretation, caused widespread hot. Especially on the qualitative issues of libel and disturb the crime, the jurisprudence of constant controversy, showing contending states. This part is the analysis on the basis of some scholars point of view.Part â…£:The Part made some improvement of the network rumors criminal regulation proposals. The first section lists the practice in some other countries, and analyzes the revelation of these practices which bring to our country, and finally put some of my suggestions, hoping to bring some help to Internet rumors of Criminal Regulation.
