Research On The Criminal Regulation Of Internet Rumors

With the popularization of the Internet and the improvement of technology,network rumor crime is becoming more and more serious,and the harm caused by network rumor is becoming more and more serious,not only for individuals,legal persons and other subjects,but also for the destruction of social order.At present,there are still many problems in the criminal law regulation of Internet rumors in our country,and there are some defects in the criminal law itself,which leads to our criminal law can not play a better role in curbing Internet rumors.Therefore,it is urgent to conduct in-depth research and Discussion on the criminal regulation of Internet rumors,find out the existing problems,and then solve them pertinently.Starting from the concept,basic characteristics and social harmfulness of Internet rumors,this paper studies the main charges and current legal provisions of regulating Internet rumors in China,finds out the problems of criminal regulation of Internet rumors,and puts forward reasonable solutions to the problems.In order to express the views of the article more clearly,This paper divides the main content of the article into five parts:The first part is the introduction,which focuses on the realistic background and significance of the topic,and also includes the research review of all kinds of literature consulted and studied at the time of the topic selection,as well as the innovation and deficiency of this paper.The second part is the basic theory of network rumor,mainly introduces the concept,basic characteristics,social harmfulness of network rumor and the current situation of the regulation of network rumor in our criminal law,and analyzes the main charges of regulating network rumor in our country,including defamation,fabrication,intentional dissemination of false information and other charges.In the third part,on the basis of the cognition of the regulation status quo,it focuses on the in-depth analysis of the problems existing in the current criminal law regulation of Internet rumors.It is mainly reflected in the deficiencies of the accusation system,the lack of subject responsibility,the unreasonable division of criminal responsibility of joint crime,and the unreasonable allocation of penalty.The fourth part introduces the Enlightenment of the foreign legal regulation of Internet rumors to our country,introduces and analyzes the regulation of Internet rumors in the United States,Germany,Britain and other countries,and focuses on mining and discovering the reference of foreign legal regulation of Internet rumors,as well as the profound enlightenment to our domestic students.The fifth part is the core content of this paper,which introduces the suggestions on the criminal regulation of Internet rumors.It mainly includes: the accurate application of relevant charges,the standardization of the main responsibility,the scientific division of criminal responsibility of accomplice,the improvement of penalty allocation,the exploration of the application of "Prohibition of Internet punishment".
