The occupational safety and health of workers’ is widely concerned by the world,it is directly related to workers’ safety and health, and the stable of society, it affectsthe process of China’s economic and social progress. Our country has issued relevantlaws and regulations of occupational health, the situation of workers’ occupationalhealth is not optimistic, the incidence rate of occupational disease is increasing yearby year, the number of occupational disease more than doubled between2005and2012, pneumoconiosis and occupational poisoning has become a high incidencedisease, not only make the national economic loss, affect social stability and harmony,but also affect the normal development of the physical and mental health of workers.The developed foreign countries have studied earlier the legal protection of theoccupational health right than our country, and its legislative system tends to beperfect. America established the multi-level occupational health supervision system,England established good legal system of occupational health protection, Japanestablished a strict and comprehensive inspection system of occupational health. Thispaper mainly introduces the occupational health legal system and supervision systemof this three countries, and analyses from the macro level, which has importantreference meaning to our country.In contrast, the occupational health legal protection system needs to be improvedand strengthened, lack of a comprehensive law and supervision, workers are lack ofconsciousness to protect their rights, enterprises are lack of corporate responsibilityand so on, This cause occupational accidents and diseases frequently happened in ourcountry. In view of the existing problems of occupational health legal protection inour country, this paper from the legal system, supervision and legal relief to putforward the suggestions of perfecting the occupational health legal protection system, in order to strengthen the legal protection of workers, ease the conflicts betweenemployers and employees, and earnestly safeguard the legitimate rights and interestsof workers.
