Since the reform and opening up, China has always rapid economic developmentas the main objective of all the people strive, high-speed operation of the economy,market competition, the employer of workers increasingly stringent requirements,overtime, poor working conditions, workplace stress brutal competition in the job, aswell as in the blind pursuit of economic benefits on the physical health and mentalhealth workers indifference and neglect have serious impact on the physical and mentalhealth of the workers. Female workers of sexual harassment occur frequently in recentyears, employees revenge corporate events, events such as the workplace insultDescription occupational mental health protection law is well imminent. In our country,for the health protection of workers, has been the "Labor Law","Occupational DiseasePrevention Law","Mental Health Law and other laws of the fairly detailed and norms.However, occupational mental health preventive and remedial measures have not beensufficient manifestation, needs to be improved. Only both concerned with workers’physical health but also to the mental health is a fundamental safeguard the health ofworkers rights. The significance of this paper is, on the one hand to strengthen thetheoretical knowledge, to fill gaps in this area, both foreign advanced experience oflearning summarized proposed rationalization of theoretical support for the domesticrealities; on the other hand, hopes to promote the theory of practical, realistic, andpromote legal perfect. Article itself novel conception, the lack of a more comprehensivereference, so the theoretical value of this article. Of Employee Assistance Programauthorized, proposed legal norms "Employee Assistance Program" a combination ofmechanisms, new ideas for double protection of workers’ occupational mental healthrights.In addition to the introduction and conclusion, the body is divided into five parts:The first part is a legal analysis on occupational mental health of workers,including definitions, types and characteristics.The second part is to start from the practice of foreign law on the protection ofworkers’ occupational mental health, further to learn more about foreign laws andregulations on the field and practice, learn from the advanced experience of perfectingthe legal blank. The third part is the domestic occupational mental health protection of the statusquo of the legal system of inquiry that seeks to understand the current legal progress inChina, provide a theoretical basis for the constructive comments made after.The fourth part is to analyze the problems of the domestic workers’ occupationalmental health protection today, from the fundamental identify the problems andprescribe the right medicine.The fifth part is to put forward suggestions for improvement of the legal system ofworkers’ occupational mental health protection. Feasible suggestions, making the legalsystem from a legal perspective, further regulation violations on the mental health ofworkers, improve the protection of workers’ rights and interests.
