The Research Of The Freedom Of Expression On Internet In The Legal Environment

Freedom of expression (or freedom of speech), have been written in the constitution as a basic civil rights Many countries in the world, accounted for about87.3%of the total. In the western theory of law and constitutional law, it is "the fundamental rights" and "first power". In the60’s, the emergence of the Internet has spawned a new form of expression-freedom of expression on Internet. Under the network environment, the freedom of expression plays an important role in achieving maximum freedom, promoting the construction of democratic rule of law and promoting the comprehensive development of individuals and so on.However, as Mr. BaiZonghua said,"technology is originally a kind of ability, is the greatness of the human intelligent discovery, used properly, is a factor in the success of every culture and the foundation of human happiness possible; Used nor correctly, in the hands of the barbarians nature can destroy all human culture. So curse or blessing, proper or improper, the responsibility is not technology to negative, but responsible for a philosophy." The main body, content of default, limitations of the public opinion and the gap between public discourses, about freedom of expression on Internet, making people from all walks of life have been mixed. The European and American countries are also gradually from "Non-regulation" age into the era of the "regulation", to strengthen the network legislation and look for a new legal boundaries, according to the characteristics of the Internet.This paper is devoted to studying the legal limits of freedom of expression on the Internet as a new issue. It mainly includes six parts; the first part is about basic theory research. The second part is about the characteristics of the freedom of expression under the network environment. The third section is about the conflicts of interest of the freedom of expression on the Internet. The fourth part analyzes the legislation situation at present as well as the defects. The fifth part introduces the regulation principles aboard about the freedom of expression on the Internet. The sixth part puts forward some Suggestions.
