Abstract/Summary:
Freedom of expression is an ancient but everlasting topic.It is ancient,because it is an important part of the generation of human rights struggled by the sage of antiqutity.It is everlasting,because the ways of realizing freedom of expression are changeable.And the changes will inevitably lead to social changes.To be specific, all of the behaviors of expression must depend on some ways or mediums.And the mediums determines the depth, breadth, scope and even efficiency of expression. As a new medium, the network space has grown to be a virtual world,which stands up to the real world as an equal and makes all the governments must take it seriously.Though scientists are ready to greet the Network Era cheeringly, scholars on politics and law are not so optimistic about it.From the perspective of freedom of expression, the disadvantages of the Internet are as obvious as its advantages.And the problem can not be avoided. However, scholars seem to expect more about the Internet. In general, whether the emergence of the Internet and the rapid development of the expression on the Internet could contribute to a significant change in Chinese society? And whether they can really promote China's construction of take a giant step forward? However, if the results are not better than what we expected, which role will the Internet play at least? And how can we meet the unavoidable challenges when we have it play its active role?Based on the traditional theory of freedom of expression,from the standpoint of positivism,this paper analyzes the development of the Internet quantitativly and qualitatively by depending on the latest data issued by the authorities. And the author tries to give its own opinions about the the events occurred on the Internet in recent years.This paper is divided into three parts. In the first part, the author summarizes the background and theory, and focuses on the traditional theory of freedom of expression and the constitutional value of freedom of expression. In the second part, the author discusses Chinese Internet users using the latest authoritative data and statistics.And the author tries to find the representativeness of the discuss on the Internet and whether the disccuss fit for the normal public opinion from the standpoint of the citizens' participation in the administration and discussion of state affairs and enforcement of political rights.In the third part, the author analyzes the of characteristics and significance of freedom of expression of the internet while China is in the transition period. In the light of the features of the Internet,the author discusses how should the government do to make the best use of its advantages and avoid its disvantages.
