In the current process of building a democratic state under the rule of law, advocacy of harmonization is the desire of the Chinese Communist Party and the while country, while having everyone entitled to freedom of speech is the fundamental requirement of a democratic nation. Now in China, the rapid development of network technology has greatly expanded the forum where people can air their views and claim their rights. Citizens can express their opinions about public affairs and current political events on a much more equal, more convenient and freer basis than any time in the history. Although the Internet has incomparable advantages over traditional media in terms of information dissemination, the blind side of online media has also brought many problems to light. Weaknesses like anonymity and strong interaction in cyberspace to a certain degree renders national interests, public welfare and private interests of society members at a risk. In the new type of online environment, how to achieve the fine interaction between cyberspace and its surroundings has become an issue which calls for urgent attention of the present age.The thesis will probe into legal regulation upon freedom of expression on internet infire chapter. First of all,the first chapter will start from discussing about the characteristics of the freedom of expression on internet, then analyze the uniqueness and differences from traditional expression and confirm its unique values. The second chapter analyzes in combination with the characteristics of freedom of expression on internet the great challenges to civil right, national security public order and public morality brought by it. The problematic freedom of expression on internet not only needs constitutional and legal protection, but requires necessary restrictions. Therefore, the following chapter in two dimensions of protection and restriction will discuss about the theories and their derivate principles that the freeom of expression on internet should be under maximum protection and should be restricted by government. The fourth chapter will in two aspects of legal regulation and industry self-discipline, illustrate the successful models that adopt good regulation toward freedom of expression on internet among the countries of America, England, Korea and so on. And then find out the successful experiences from which our country can draw. The last chapter will analyze the current situation of China’s regulation on freedom of expression on internet and then come up with ideas and suggestions upon how to regulate it. The above five chapter go further step by step. This thesis from the legal standpoint deepens its discussion about the series of questions on legal regulation on the freedom of expression on internet.
