Thesis On The Legal Status And Reform Goals Of The Prefecture-Level City In Our Country

The appellation “prefecture-level city” has been widely used by us now. Actually in thefeudal society of ancient China, the local administrative divisions gradually produced is equalto the current level in the administrative hierarchy, such as the Ming and Qing dynasties “fu”,“state”(zhili state) is similar to the prefecture level now. In the early days of New China, wedivided the local administrative region into provinces (autonomous regions and municipalitiesdirectly under the central government), county (autonomous county) and town(villages,nationality township), prefecture level does not exist in the administrative hierarchy level, butbecause our country is vast in territory, and the number of provinces is small and the area ishuge, the jurisdiction of the county administrative region number is more, so we set up some“zones”(later changed to “areas”) as the local agencies of the provincial government in orderto reduce the burden of the provincial government. Before “the merger of the cities”, theprovincial administrative regions also govern a large number of municipalities. So there’s thephenomenon of city and regional coexisting. Since the eighties, many places began to practicethe “merger of cities”,“city”,“city” between the provincial and county level administrativeregions between the resulting administrative level. At present our country included more than300regional administrative areas. Since the reform and opening-up policy of China, thecenter of the city in regional administrative area had developed so much. In the process ofaccelerating urbanization in the future, more than300regional administrative areas of the citycenter undertake a glorious and heavy task.Prefecture-level city still has many problems, including the law issues and administrativeissues. At present, our country is undergoing the reform and trying the “provincial directlygoverning county”, many experts and scholars argues that we should cancel the cities as theadministrative hierarchy in the future. In theory, the idea is very beneficial to the developmentof our country in the future, but the author come up with various attitudes. The author thinksthat, the setting of the prefecture level is very necessary from the actual situation of China’scurrent, the idea of canceling the administrative levels of conditions is not mature enough. Our first imperative is to perfect the legal status of administrative, based on the reserve leveland scope of administrative divisions, the respect such as operation mode to reform and so onour country’s social stability, economic development and urbanization process will have agreat role in promoting. In this paper, the author analyzed the administrative concept, type,historical evolution, the prefecture level in the position in the current law, the presentproblems of the city,“county” was made on the impact of the prefecture level position, keepthe necessity of the prefecture-level city and so on. In comprehensive on the basis of aboveanalysis, this paper puts forward the ways to perfect legal status of the prefecture-level cityand the administrative reform goals.
