Study On The Germany Renewable Energy Law And The Enlightenment To China

Energy is the material basis for social development, and human lives. China andGermany are big energy consumption countries, are all faced with the dual pressures ofmaintaining security of energy supply and environmental protection. Renewable energy asan important component of energy, by virtue of its clean and recyclable characteristics rolein the energy mix gradually improved. Renewable Energy has played an important role forthe protection of security of energy supply and protecting the ecological environment.Therefore, China and Germany are committed to the development of renewable energylaw, the use of legal means to promote national renewable energy healthy and stabledevelopment.Germany’s Renewable Energy Law started earlier, its sound legal system, the totalamount of clear objectives, scientific rigor and clarity of legal norms legal rights andobligations of the body so that it is known as the world’s most advanced clean, renewableenergy law. This paper aims to study the German Renewable Energy Law, by comparingthe historical development of the German Renewable Energy Law to clarify its legislativeideas, legislative purpose, the legal system and the legal system, analysis and evaluation ofthe German Renewable Energy Act of advanced legislative experience. China’s renewableenergy law developed relatively late start in other countries of the world, which is still theearly stages of development, in development practice also exposed many problems, forexample: Most statute too principled, lack of practical operational, legal liability is notclear, renewable energy and other development goals vague and so on. So we can refer tothe experience of Germany advanced legislation to improve the development of China’srenewable energy law.This paper aims to study and learn from the advanced German Renewable EnergyAct, combined with basic national conditions of China’s renewable energy development,put forward useful suggestions to improve and build our relatively complete legal systemfor renewable energy, accelerate the country’s renewable energy development, ease thebottleneck of energy supply, to build a resource-saving and environment-friendly societyto make some contribution.
