There are a lot of experiences on abroad is worthy of learning for us, our country’s renewable energy policy also created environment to apply the renewable energy quota system. Renewable energy quota system is effective to promote renewable energy development vigorously. Renewable energy law of 2006,2009 modification has been created for renewable energy quota system in our country based on the root system environment. China has drawn up a renewable energy quota system of several files, but delayed their implementations. In 2012 the responsible department formulated the measures for the management of renewable energy electricity quotas (discussion paper), after two years of repeated revision and discussion, finally in August 2014 the responsible department voted and passed it. However, the measures for the management of renewable energy electricity quotas (discussion paper)) less many terms, provisions content is relatively single, lacking of operability and guidance. The structure of renewable energy quota system is framed by quantitative renewable energy goal, main body, green certificate trading system and supervision system. To build the renewable energy quota system, we should start from the following aspects: first, the quota obligation subject is power generation company, the electric power enterprise and local government, who undertake the feasibility of the quota target, making sure that the renewable power is given well by the market, providing powerful guarantee for the sustained and healthy development of the renewable energy; Second, making scientific and reasonable renewable energy quota total target from large to small, then refinement it, eventually completed different quota obligation subject one by one. Provincial government the relevant departments of the government plan to give responsibility, establish renewable power incentive mechanism; Third, renewable energy quota system makes our country electric power system with renewable energy generation mechanism actively cooperated. Green certificate trading mechanism can effectively solve the local government and power generation enterprises investment problem of high pollution and low cost power projects, reducing government financial pressure and reaching the realization of carbon reduction target; Fourth, we should adopt reasonable means to solve the conflict of interest in the process of the green certificate trading to reduce conflicts and disputes; Fifth, building a unified regulation and departmental regulation to promote renewable energy quota regulation system perfect; Sixth, the quota index of completion shall be incorporated in the corresponding evaluation system. Quota obligations undertaker unfinished quota target, they can get a grace, at the end of grace period the quota is still not completed, they need to bear the legal responsibility. Renewable energy quota management agencies and regulators abuse their administrative power need to take a number of administrative responsibility. Based on the legal system construction of renewable energy quota, it is transformed into institutional norms, which is advantageous for the practice. The setting of renewable energy quota of legal liability defined the responsibilities of the subject type and amplitude, formed a deterrence to actively complete legal obligation, helping to improve the application of the renewable energy quota system.
