A Study On The Legal Issues Of Renewable Energy Exploitation

Improving energy efficiency and developing renewable energy have become two wheels of the sustaining development of global energy resource. To fulfill sustaining development has become an important elementary policy in developing the economy of Chinese society. Based on the requirement of mutual coordination between positive development and population, resources, and environment, exploring how to take into consideration both the two problems—the problem of comprehensive benefits in economy, society and environment and the problem of sustaining development—is a major issue our country is faced with. In recent years, with the increasing demand for energy as the economy grows rapidly, the exploitation of traditional energy like coal, oil, etc. has been more and more restrained by the conditions of resources, environment and transportation. Therefore, whether energy could achieve sustaining development will affect the healthy and stable development of society and economy. With the dual task, economic and social development and environmental protection, to reconstruct reasonable energy structure and to strengthen the legislative construction on renewable energy are extremely necessary. In our country, the legislation and enforcement of renewable energy has just started. The approval of the law has great significance in promoting the exploitation of renewable energy, increasing energy supply, improving energy structure, ensuring energy safety, protecting environment and fulfilling sustaining development of our economic society. However, in our country, due to many existing barriers in the exploitation of renewable energy and the problem itself, and the unsound system of law in the process of exploiting renewable energy, in order to consider different local situations, the central government and the local government should make matching laws, regulations and criteria in time, so as to further construct a system of energy law with Chinese features, that is, a stable law system, having practical content and validity, based on the combination of basic law and specific legislation, which consists mainly in National People's Congress'legislation and State Council's administrative laws and regulations, partly in sectors'regulations and local laws. It is an integrated whole which takes the basic law of renewable energy as the core and has its complete specific laws, composed of renewable energy laws of many layers and all sorts.The research starts from the problems concerning the law of exploitation of renewable energy abroad, at home and in different regions at home. In view of other countries'mature relevant laws, I put forward some suggestions on the laws of renewable energy exploitation, in the hope of contributing a little to the sound recycling of energy market in our province so as to promote the harmonious coexistence between human and nature.
