Study On The Construction Of Legal Charges

In this paper, we study and analyse the specific composition of the legal charges constructional meanings in the ancient and modern laws.We sum up the constitutive factors of the application of the legal charges of the ancient and modern.These factors are not only involved in the constitutive elements of the charges, but also the components of the meaning of the charges.When the component exists in the entry of the charges, then this factor is not in the structure.Through the contrast between the past and the present in this phenomenon,we can see that the inheritance and evolution of the name of crime since ancient times.Through further analysis of its causes, we can finally draw some relatively stable basic invariant normalization and naming rules,we can also provide some references in naming and standardization for people in the future.The second chapter is the construction of the modern legal charges.First of all, the definition of "criminal law" is consistent with the construction of the constitutive model.Then through the prototype construction, we can get the construction of the overall structure.And then analyzes the construction of the structure generated by the edge of the construction of the meaning of repression.On the basis of the determination of the construction of the prototype and the structure,we segregate and induce the constructional meaning of specific composition,eleven factors which can be used in the construction of constitutive meaning and the meaning of the eleven elements are obtained.on the basis of the classification of the crime, we construct a complete set of construction sequence.The third chapter is the construction of the ancient legal charges.Because of the long span of time, after the changes of the complex dynasties, political changes and other aspects of the reasons, the selection of Chinese ancient charges becomes extreme difficult.In this paper, on the charge of the selection,we start from the ancient law dictionaries clearly marked on the charges,then to the modern criminal law with the same format of the "X+zui", and then further extended to other special circumstances.After selecting research object,we analyse the ancient charges by the methods which are same to the modern charges.We also find that compositionand components of meanings of the ancient and modern charges are basically the same.The fourth chapter is the practical value of the research of the charge structure.On the construction of the constitutive law of the modern legal charges, this paper puts forward a relatively feasible and unified framework for the interpretation of the crime of the modern legal dictionary.We illustrate the complete sequence of constructional meaning assignment for 1 items one by one, especially on the four essential factors of the interpretation made a detailed explanation.The greatest value of the study lies in the situation of ancient and modern comparative constructions of semantic components in word formation,draw its inheritance and development of the actual situation and analysis of the reasons,And then sum up the future name and reference suggestions on standardizing linguistics.The fifth chapter discusses the shortcomings of this study and the space which can studied in the future, and study on the legal charges in the future is prospected.
