E-C Translation Of Patent Applications From The Perspective Of Functional Equivalence On Legal Level

With the rapid development of global economy and technology, the number of patent applications in the world surges a lot, especially those under the framework of the International Patent Cooperation Treaty(PCT). Since China’s economy continues to grow, the growing influence of China’s market is prominent, and as a result the demand for the E-C translation of patent applications largely increases. For the translation of a patent application, a translator should thoroughly understand the ideas of an inventor and use accurate and clear expressions to completely transfer the information contained in the patent application into a target text, in the process of which, the transferring of “legal-intention information” embodied in the original application is particularly important. In this thesis, the “legal-intention information” is defined in three major aspects: patentability, the scope of protection, and form and diction. The importance of achieving the three major goals is emphasized in this thesis and Nida’s Functional Equivalence theory is applied. A new concept of “functional equivalence on legal level” is proposed to achieve the three major goals and strategies and principles of translation are proposed as follows:(1) familiarity with relevant patent laws and regulations;(2) literal translation strictly observed;(3) transmission of legal-intention information prior to readability.
