Mo Yan is the first Chinese writer of "the Nobel Prize for literature". Once published, Mo Yan’s epistolary novel "Frog" has received the widespread attention. “Frog” is a novel on the subject of family planning in historical background of the People’s Republic of China(PRC). It shows Family planning’s execution problems and shortcomings in the form of literature.Firstly, the dissertation does a systematic research on the formulation and evolution of Family planning. In the early 1950 s, population explosion led population policy began to shift to ‘birth limitation’. In 1960 s Family planning policy was formally introduced and achieved initial results in urban areas. Strict Family planning policy was rolled out across the country in 1980 s, yielding remarkable achievements but also was controversial. At the beginning of the 21 st century, the introduction of “population and family planning law of the People’s Republic of China” marked the embedment of Family planning into the national basic law. In 2013, the policy started to loose and “separate two children” was allowed. On one hand, Family planning generates outstanding achievements in many aspects including population control, shift in population reproduction types, liberate of women and promote economic boom. On the other hand, it also has many problems: resistance stems from the traditional family ethics in initial stage, constant interests conflicts between law enforcements and the citizens in medium stage and birth population structure imbalance, aging population, and pension difficulties in post-policy period, as well as “off responsibility once pay” social support management mode setting the policy into an awkward situation.Secondly, the dissertation analyses Family planning in “Frog”. “Frog” presented Family planning execution problems in rural from two aspects: history and reality. Historical focus on the power of individual discipline, while realistically focus on life alienation and the predicament of Family planning. Analyzing law-related literature from a legal perspective has a great significance. Literature can cultivate an Objective and comprehensive historical conception, which helps scientific legislation. Poet-judge can fill the role of legal justice and guide the formation of justice attitude. Astronomers use literary imagination and emotion to advocate "poetic justice", which can be a balance of national and era. At the same time, Literature’s significant to law is limited. This limitation comes from both the creators and literature itself.From "Poetic justice" we can see that, in the context of law-based China, Family planning should be made to ensure reproductive rights as the standard, innovate management mechanism, improve the service level, and pay attention to the improvement of population quality and long-term balanced development. At the same time, in the process of solving the problem of rural policy implementation, we should truly administer according to law and protect citizens’ legitimate rights and interests in accordance with the administrative principle of proportionality, trust protection, and unified specification of the power and responsibility.
