| BackgroundThe contradiction between doctors and patients has been a long-standing problem in China, and report on various kinds of medical malpractice and "medical disturbance" incidents on the network is frequently in recent years. Medical malpractice and "medical disturbance" has seriously affected the doctor-patient relationship under the background of harmonious society, seriously disturbed the normal order of hospitalize in the hospital. The ultimate victims of deteriorated doctor-patient relationship are still patients, especially rural patients whose related law knowledge is relatively weak suffers the most serious hurt. Because of the increasingly intensified contradiction between doctors and patients, medical malpractice are becoming increasingly intense, which has brought great hidden trouble to social stability and harmony, and also aroused great attention of the government. In the last three years, the state has issued a series of policies and regulations aiming at the above problems, which has brought a huge impact to the medical environment.Against this background, I analyzed and studied 102 cases of medical malpractice happened in a second-class hospital in Anhui Province in recent years whose main body is rural hospitalized patients. Based on the current status that our country is focusing on the governance of medical malpractice and "medical disturbance" incidents, to explore occurrence of medical malpractice for rural residents’ hospitalization, as well as ways and measures for medical malpractice under the new situation, so as to provide reference for other hospitals to formulate relevant system to prevent and deal with medical malpractice.Purpose of Research:The overall purpose of this research is through analyzing and studying 102 cases of medical malpractice of rural hospitalized patients happened in a Grade II Class A hospital in Anhui Province from January 2009 to December 2015, and based on the situation that our country has made great efforts to renovate "medical disturbance " in recent years under the national conditions of law-based governance, to discuss whether the medical malpractices of rural hospitalized patients and occurrence trend of "medical disturbance" has changed or not, and to explore ways and measures of resolving medical malpractice under the new situation, so as to provide reference for other hospitals to formulate relevant system to prevent and deal with medical malpractice.Method of Research:The data and cases required in this research are from total 102 cases of medical malpractices of rural hospitalized patients which happened in a Grade II Class A hospital in Anhui Province from January 2009 to December 2012 which were all officially registered, disposed and filed. Data collection includes a seven-year process of rural residents inpatient medical malpractice occur, the number of cases, hospital departments, malpractice handled method and period, the amount of compensation and other data. Combined with a large network of information, CNKI, VIP and Wanfang Data and other databases to learn about the current situation of domestic and foreign medical malpractices and "medical disturbance".Dates of 102 cases of medical malpractices of rural hospitalized patients which happened in a Grade II Class A hospital in Anhui Province were input and analyzed by EXCEL, mainly use the case analysis method and quantitative analysis method, through vertical comparison and horizontal comparison, analyzed the case quantity and trend of medical malpractices and "medical disturbance", analyzed the hospital department in which happened the medical malpractices, analyzed the specific ways of solving the malpractices, analyzed the reason why malpractices happen, analyzed the indemnity obtain through different ways to solve the malpractices and other situation.Main Result:1. Through analysis of overall situation of medical malpractices of rural hospitalized patients found that overall trend of hospitalized malpractices of rural patients is in a down trend; the main reason for the occurrence of medical malpractices is medical damage and liability accident; Orthopedics Department, General Surgery Department, Obstetrics Department are malpractices-prone departments.2. Through analysis of solve situation of medical malpractices of rural hospitalized patients found that 72.2% of the malpractices were solved by negotiation between doctors and patients; malpractices solved by civil action were mainly medical damage, average time needed by civil action was 331 days; the main reason caused "medical trouble" by rural hospitalized patients was medical damage, Orthopedics Department, Otolaryngological Department, General Surgery Department, Pediatrics Department were the main "medical disturbance" occurred departments; "medical disturbance" of rural inpatients were mainly occurred before 2013, "medical disturbance" incidents were not occurred in 2014 and 2015.3.Through analysis of compensation condition of medical malpractices of rural inpatients found that the compensation amount for each case of malpractice is in a rising trend year by year; compensation amount caused by medical damage is the highest, the average compensation amount for each case is the highest; compensation amount from Obstetrics Department, otolaryngological Department, Cardiology Department, Thoracic Surgery Department, Medical Oncology Department are higher than average amount; the highest compensation amount is obtained through civil action, the lowest compensation amount is obtained from negotiation between doctors and patients; the highest compensation quantity is from "medical disturbance" caused by medical damage, the highest average compensation is from "medical disturbance" caused by shortcoming in administration; small amount compensation range occurs a lot of "medical disturbance"; the compensation amount of medical malpractices which has action at law is higher than medical malpractice which don’t has action at law; the highest compensation quantity is from lawsuit caused by medical damage, which has the highest compensation amount for each case; compensation amount is related with medical appraisal institute and medical accident appraisal level.Countermeasure and Suggestion:1. Strengthening the internal hospital management and stifling the medical malpractices in the bud2.Increasing the service consciousness, humanistic consciousness and communication consciousness of health care workers3. Improving the settlement mechanism of medical malpractices4. Improving the commercial insurance system of medical malpractices5. Resolutely defeat the behavior of "medical disturbance", safety is the baseline of medical activities6. Strengthen the legal publicity and make right guide of public opinion... |
