The Legal Problem Of Our Government’s Response To Vaccination Public Health Events

At present, our country is being in a society transformation period, and immunization public health events occur frequently which exposes the immunization public health system exists many problems in our country. In the vaccine producing stage of research and development, confined to our country’s current economic development level and variety of social and economic factors, within the immunization system the government’s ability to have price on vaccine is low, and correspondingly in the market, the profit elasticity is small which affects the enthusiasm of the enterprise to have production upgrade. In the market pricing stage, the price of the second class national immunization unplanned vaccine is adjusted by market due to the existence of product, wholesale, transportation and so on many other processes, with the absence of government’s subsidies, its market price may little higher. At the same time in the inoculation stage, during the implementation of national immunization plan,vaccination funds diverted, hysterectomized and cold chain construction is not seriously obeyed.Due to the uneven development of vaccination work throughout the country, in some urban areas insufficient vaccination personnel affects the actual coverage of the vaccine.Compensation mechanism of adverse events following immunization has not yet been established. In the process of dealing with public health events, there is not enough national vaccines reserve and at the same time due to our current limitation of vaccine production capacity and the reserve ability can’t follow people’s rapid demand. So it is a tough problem to deal with the large-scale outbreak of vaccine quality accident. Now at the system level, our government is trying to build AEFI response mechanism. To improve immunization safety issue is one of the government’s major job.This paper tries to clarify the current immunization events of public health response, analyze its existing problems, and explore to improve our ability to deal with AEFI. In the process of thesis writing In order to have accurate describe, this paper grasps the present situation on the case discussion with the combination of research methods. The article develops from four aspects. The first part briefly introduces the basic concepts in the process of vaccination, such as vaccination, the vaccine, vaccination reaction, the method and way to vaccination.Vaccination response is analyzed emphatically to the extent that constitutes a public health emergency. The second part discusses the existing legal system of public health response to vaccination, and try to discuss the exposed problems of public health events The third part, discusses the inoculation against our country public health event handler, vaccine safety accident compensation problem. The fourth part from the vaccine research and development, production, circulation, the four stages to be vaccinated, ensure the inoculation against security, to avoid the public health event.
