Objectives:To know about medical staff’s awareness degree on tort liability law compensation for medical damage, to discuss the factors influencing medical staff’s awareness degree,to provide scientific basis on the intervention in legal knowledge of medical staff.Methods363medical workers chosen as samples by random cluster sampling from15different technical offices in a comprehensive hospital, answered the self-designed questionnaire, which includes the following contents:social demography materials, medical staff attitude towards medical disputes and pyhsician-patient relationship, medical staff’s awareness degree on tort liability law compensation for medical damage and their medical behaviour. The results were analyzed by Descriptive Statistics, Nonparamentrictests, Chi-square test.ResultsThe degree of awareness on tort liability law compensation for medical damage was classified into three groups, bad knowledge-mastering group73cases (20.7%), ordinary group243cases (68.8%) and excellent group37(10.5%).By single factor multiparameter analysis it shows that there are some factors influencing medical workers’degree of awareness on tort liability law with statistic magnificance as follows:the difference on their degree of awareness on tort liability law between both genders has statistic magnificance (Z=-2.220, P=0.027), different technical offices (Z=55.079, P=0.000), their attitude towards the relationship between physicians and doctors (H=9.498,P=0.023), situations of their mental stress (H=9.498,P=0.023), implementing the obligation to disclose (H=31.002,P=0.000), providing or duplicate medical record (H=30.173, P=0.000), their medical treatment tprinciple (H=24.804, P=0.000), their check-up principle (H=28.532P=0.000), and their measure to dispose of medical trouble incidents (H=46.647,P=0.000) By bringing ralated risk factors mentioned above into multifactor logistic regressiom model, it show that implementing the obligation to disclose, providing or duplicate medical record, respecting patients’ privacy are protctive factors of medical workers’degree of awareness on tort liability law, their views on the current relationship between doctors and patients and mental stress are risk factors, the value of OR and95%CI are as follows respectively:0.461(0.296,0.295).0.586(0.412,0.832),0.503(0.315,0.802)>1.911(1.093,3.340),2.123(1.185,3.r).Conclusions1. The female and medical workers from the technical offices encountering medical disputes easily master the knowledge about tort liability law better.2implementing the obligation to disclose, providing or duplicate medical record, respecting patients’ privacy are protctive factors of medical workers’ degree of awareness on tort liability law, their views on the current relationship between doctors and patients and mental stress are risk factors. Medical workers should be provided more legal education in order to reduce reasons for medical negligence.
