Classification Of Characteristics And Reason Analysisin Clinical Nursing Tort

Objectives To analyze the clinical nursing tort case collected, understand its distribution,combined with the "nurse’s regulations","law of liability for tort" and other laws,regulations and provisions in explaining the causes, characteristics. At the same time, learnfrom advanced foreign experience suggests countermeasures and improvement measures,to provide the reference for clinical nurses and nursing managers.Methods Using the literature analysis method to consult, summarize, analysis, domesticand overseas nursing tort theory; by χ2test on nursing tort distribution and characteristicsto describe; the typical case analysis of the typical case of "nurse’s regulations", with " lawof liability for tort " the relevant provisions of the cause analysis, interpretation of nursingtort.Results In recent years, nursing tort behavior shows the trend of increasing year by year.Nursing age <10years，Tort behavior was related to the degree of education of patients,accounted for88.08%, higher education, awareness of rights stronger. Nursing tortbehavior is independent with the patients in medical insurance. Nursing tort behavior bringdifferent degree of damage to the patients, but the degree of damage distribution and theDepartment has no obvious relationship; surgery was the highest in nursing tort, accountedfor36.17%, followed by the Department of pediatrics medicine, accounted for22.1%, andbecause of technical operation caused by professional operation; again, for violations ofthe privacy caused in gynecology. The main solution is to intervene by hospital, and mostcases have been effectively reconciled.Conclusions Through the analysis of nursing tort, summarized the nurse self factors andmedical institutions management systems are not perfect, legislative defects are the maincauses of nursing, on the other hand, the effect of treatment of patients with highexpectations, rights awareness is too strong. The nurse self factors mainly include: thenurse in clinical nursing practice behavior was not standardized; the legal consciousness ofnurses is weak, ignoring the rights of patients; nurses lack of responsibility; nurse patientcommunication with the shortage of nurses; professional and technical level is not up to thestandard. The main nursing management system in medical institutions is not perfectembodiment of nursing personnel allocation and nursing management system is not perfect in two aspects. The nursing staff can strengthen the inside and outside hospital professionaltechnical appraisal, humanistic quality education, legal knowledge training, to improvetheir comprehensive quality; medical institutions should increase nurse staffing, scientific,humanistic management of nursing work, but also to learn from foreign experience, wecontinue to improve the nursing legislation in China. It is necessary for patients and theirfamilies to understand medical uncertainty and high risks by point medical knowledgeeducation. So in the medical institutions, nursing managers, nurses and social efforts toprevent nursing tort occurred, to build a harmonious relationship between nurses andpatients and improve the quality of nursing service.Table15; Reference73...
