Guangzhou TCM Patent Quality Status And Development Strategies

ObjectiveIn this article, we build data base by collecting Guangzhou TCM patent database between2001and2010for the purpose of:1.To know the changing and development tendency in applying Guangzhou TCM patent.2. To get the patent quality index.3. To evaluate patent quality and analyse factors that influence patent quality by applying patent quality index.4. To put forward some suggestions for establishing Guangzhou TCM patent policy and developing stratecy.MethodsThis article includes theoretical research and empirical research. First we define patent quality theoretically and set patent quality index. Then we use empirical research methods to verify the effectiveness of the index to construct the patent quality index. The following is specific method:1. Souces of patent data:Searching the patent information service platform (http://search.cnipr.com) by key words" Chinese medicine manufacturing Guangzhou" and "2001to2010", we found1066patent data.2. Construction of patent database:the retrieved1066download full text patents and patent legal status to extract information and citation information, patent documents retrieved one by one to read, to retain documents related to the study, excluding irrelevant, eventually left995patent data to meet the requirements to establish the total database; selected has been granted patents from the total database, make sure to "maintain the first four years of post-grant patent" which patent license under patent belonging to the date and the expiration date, which patent belongs to "the first four years after authorization does not maintain patent" in the end, screened by hand to meet the requirements of a total sample of patent429, to establish a database to maintain patent son. The total database and maintaining patent databases are SPSS17.0entry and analysis.3. Analysis of patent database:(1)Analyse of development tendency of Guangzhou patent in ten years:different types of patents patent applicants in different categories and different patent application patent Year perform application status, legal status and patent transfer rates, licensing and agency implementation rate statistical analysis.(2)Screening patent quality by whether maintaining patent for four years:Multiple Cox regression reported in the literature associated with patent quality screening indicator construct patent quality index regression equation.(3)Application of patent index in evaluation of patent database quality.Results1. Development overview:(1)The number of Guangzhou TCM patent application keeps on fluctuating.(2)Patent for invention is in the majority of Guangzhou TCM patent to patent.(3) Individuals is in the majority of Guangzhou TCM patent applicants, following businesses,shools, hospitals and so on.(4)Among legal status constitution of Guangzhou TCM patent, followed by the withdrawal of patents and patent lapsed, rejected patents and patent unauthorized least between2001and2010.2. Factors that influence patent maintain screen by Cox regression model are as follows:The number of words、cited patent documents, cited non-patent documents, transforming of patent right and number of inventors.3.The result shows that:(1)The patent index quality of patent for invention is higher than other patent quality.(2)Corporate patent index quality is higher than other patent quality.(3)The difference of patent quality index is obvious.Conclusion1. Conclusions:(1)The distribution of TCM patent applicant shows unreasonable.(2)The withdraw rate of TCM patent is high.(3)More patents get early termination.(4) The rate of patents percent conversion is low.(5) The time of patent maintaining is short.2. The patent quality index built on the basis of survival analysis is valid indicators which could fully reflect the impact of objective factors patent mainten time. Patent quality index model can comprehensively evalyate patent quality.3. Evaluation of patent quality:(1)Guangzhou TCM patent quality is divided into three grades.(2)Patent of invention is in the majortiy.(3)The patent quality from high to low are as follows：enterprises, hospitals, research institutes, universities and individuals.(4) Parent quality fluctuates obviously.4. The strategy to improve Guangzhou TCM patent quality should be based on different stages, different patent subject, produces study grinds and the emphasis on tatal quality management.
