The Research Of Legal System On Dispose For China’s Rural Straw

Nowadays, in most parts of northern China are plagued by disaster of frog and haze, at the same time,air quality is getting worse which be harm to people’s health. And haze disaster occurs simultaneously there is a large area of straw burning behavior in rural areas. This paper argues that there is certain relevance between the behavior of straw burning and haze disaster. The behavior of straw burning seriously harm the air quality, air pollution, and environment, but our nation’s legal responses to straw burning issue are not perfect with lacking of comprehensive straw supporting subsidies, at the same time, combined with China’s national conditions, some foreign experience to be able to offer our good inspiration.the paper will analyzes the current status of straw burning problem in our country as well as the causes and legal defects of straw burning issue in the text, and give ideas and suggestions.This paper is divided into four chapters, the first chapter introduces the reality in rural areas of Straw processing, and causes of the problem. Straw burning long-standing problem in rural areas, has a very deep historical reasons, the issues of straw burning has a long history with the historical, economic and legal reasons.In the second chapter, the paper analyzes the status quo of rural straw legislative process; demonstrate the present legal deficiencies for the issues of rural straw in our country. From the central level to the local level laws and regulations have certain drawbacks.In the third chapter, through the analysis of the US Mississippi straw legal measures and comprehensive utilization approach, the paper found that the straw burning total control program, subsidy funds are the implementation of powerful legal tool to deal the issue of straw burning.In the fourth chapter, the paper gives the suggestion, combined with the United States Mississippi successful stories, proposed implementation plan in total control of incineration, the establishment of subsidy funds, the implementation of comprehensive utilization of straw system.
