Research On Government Functional Location Of National Defense Patent Management

Based on Chinese context and combined with government’s reality, the paper tries to establish logical relation model of new public service theory, government functional theory of patent management, government functional theory of national defense patent management on the basis of theories and discusses interrelation between government functional theory of national defense patent management and government administration of national defense patent. It tries to disclose veils of form elements and behavior elements in governmental function of defense national patent management on the basis of analyzing government’s functional characteristics, development phase and stage characteristic of national defense patent management. From government perspective, it explores to construct government functional pattern of dynamic management and system optimization frame based on national defense creation, operation, protection, organization and service, etc and adopts interviewing method, case study method and comparative approach to verify theoretical research.The research shows that government’s functional problems in dynamic management process of national defense patent are mainly: deficiency of government guidance and incentive function in national defense patent creation; dislocation of organization and coordination function in national defense patent operation; and vacancy of governmental service function in national defense patent service. O n the basis of analyzing and demonstrating governmental function problems and reasons of national defense patent management, it suggests locating and reconstructing government function of our country’s national defense patent management, locating government function of national defense patent management concretely and in detail and reconstructing corresponding government functions combing with our country’s government system’s reality to make it have feasibility and operability. It concretely contains orientation and reconstruction of governmental functions in national defense patent creation, orientation and reconstruction of governmental functions in national defense patent operation, orientation and reconstruction of governmental functions in national defense patent protection, orientation and reconstruction of governmental functions in national defense patent organization, orientation and reconstruction of governmental functions in national defense patent service.Finally, through comparatively analyzing concrete measures of national defense patent management in countries, such as: Ame rica, Russia and Japan, etc, the paper summarizes and refers to the role and function that advanced countries play and exert in the process of national defense patent management. At the time of verifying the above government functional location of national defense patent management, it also provides reference for optimization design in government functional system of our country’s national defense patent management.
