With the rapid development of China’s economy,the competition between international and domestic enterprises is more severe.Small enterprises need to break through the technological encirclement of large enterprises if they want to grow.In the past,most enterprises in China mainly relied on reverse engineering for product improvement and design.However,as the state began to strengthen the implementation and implementation of intellectual property law protection,the new amendment to the Patent Law added severe punishment measures.Therefore,enterprises need to change their previous business strategies and strengthen the prevention and avoidance of core product technology infringement.Patent circumvention design is an effective method that can not only break through technical barriers but also save resources.The core of patent circumvention design method is the redesign of functions.However,due to the limitation of function cognition,the path of functional analysis of patent circumvention design is blocked,and the solution method of patent circumvention design is limited.This research proposes a patent evasion design method based on multi-layer functional cognitive extension to solve the above problems.The main research work of this paper includes the following contents:1.A patent analysis method based on multi-layer functional cognition and scene transformation is proposed.Firstly,a method of calculating patent value based on AHPTOPSIS model is proposed,and high-value patents are determined as target patents;Then,by extracting the situational information of the target patent function,the situational behavior process of the target patent system function is constructed with the multi-level functional cognition of the technology system as the key situational behavior stage;Secondly,based on the product technology life cycle,the scenario transformation types and key scenario elements of the technology system are analyzed to determine the new use scenario of the product;Finally,the function analysis of the existing patent technology system is completed on the basis of multi-layer function cognition with the function required by the new scenario as the target.2.A patent circumvention design solution method based on multi-layer functional cognition is proposed.Firstly,the function similarity calculation matrix is constructed,and the similarity knowledge source is determined by mapping the function similarity to the component similarity;Then,on the basis of multi-level functional cognition,with the required functions as the target,the functions carried by each system level are clarified through the reverse function decomposition process;Secondly,inspired by the principle of knowledge source technology scheme,through the positive sequence function solving process,the load-carrying function of each system level is solved,and a new technology scheme of patent evasion design is constructed;Finally,based on the principle of patent infringement judgment,the new technology scheme is judged for infringement,the feasibility of the new technology scheme is tested,and the process of patent circumvention design is completed.3.Applying the proposed patent evasion design method,a case study of patent evasion design of balance vehicle is carried out.Firstly,the target patent of high-value balance vehicle is determined by applying AHP-TOPSIS model calculation method;Then,by extracting the patent scenario information of the balance car,the multi-layer functions of the balance car are determined,and the function scenario behavior process of the balance car is constructed.Secondly,based on the life cycle of the balance vehicle technology,the new use scenarios and required functions of the balance vehicle are determined,and then the similar knowledge sources are determined with the required functions as the target;Then,on the basis of multilayer functional cognition and inspired by the knowledge source technical scheme,the patent evasion design of the balance vehicle is carried out,and a new technical scheme of the balance vehicle is formed.Finally,the correctness and feasibility of the proposed method are verified by the infringement judgment of the new technology scheme.
