A Research On The Legal System For Preventing The Pollution Caused By The Preliminary Processing Of Natural Rubber In Hainan

The rubber industry is one of the pillar industries in agriculture of Hainan, in which the preliminary processing is a necessary process in rubber production. However, on one hand, the waste water and gas and solid waste caused by the rubber preliminary processing will bring severe pollution to the environment without strict handling. On the other hand, as the growth of rubber economy, those privately small-sized factories that are supposed to close begin to reopen for the rubber benefit. The pollution accelerated by their poor technology and equipment places a strong stress on the environment. In short, the preliminary processing industry brings economic benefit while causing severe pollution to the excellent eco-environment in Hainan.The thesis is composed of three parts except introductory remarks and conclusion.In the first part, it introduces the preliminary processing of natural rubber in areas ran by Hainan States Farm and privately funded companies respectively, including the output, distribution and investment in environment protection at the beginning. Secondly, the main problems in the pollution prevention during the rubber preliminary processing are mentioned, including existing problems such as how waste water, waste gas and solid waste forms, and its handling measures. Meantime, it also analyzes the waste discharge problems critically existed in privately funded companies.In the second part, it focuses on the current situation of legal system in the prevention of rubber pollution caused by the preliminary processing in Hainan and its shortages. Firstly, the discussion will center around legal rules and regulations in both national level and local level, which will facilitate to promoting the rules on preventing the pollution caused by the rubber processing. Of which are main rules such as the Law of Environmental Impact Assessment, Water Pollution Prevention and Control Law, Solid Waste Pollution Prevention and Control Law, Regulations of Hainan Province on Environmental Protection and Interim Regulations on the Administration of Natural Rubber Protection in Hainan Province.Secondly, combined with rules and regulations and existing problems in natural rubber production, it analyzes the shortages in current legal system such as the lax rules on regulating the environment of rubber preliminary processing, unclear elimination system of backward skill and equipment and the lack of the oriented legal supervision mechanism for rubber preliminary processing. Thirdly, it mainly focuses on how to reduce the pollution caused by rubber preliminary processing through the improved eco-friendly system of rubber processing, the elimination of backward skill and equipment, the establishment of service platform of fund and technology and the improved punishment mechanism in basis of the pollution reality and legal shortage.To study the legal system on preventing pollution caused by the natural rubber preliminary processing has undeniable meaning in theory and reality. No other than the thorough legal system could drive the sustainable development the economy of Hainan in an effective way.
