A Study On The Legal Problems Of Ecological Compensation In Chishui River Basin

The Chishui River is a historic river, known as the “hero river” “wine river”“beautiful river” “ecological river”, but in recent years, water ecology of the Red River suffered serious pollution and destruction. Was this evil, must have its reasons.Red River Valley this should be a complete natural areas, as a result of human factors,is divided into different administrative regions. All along, upstream and downstream of each administrative region in its own regional interests are oriented between the work area for eco-friendly aspects of the lack of communication and consultation, in order to meet all their needs of the local economic and social development of rapid,indefinitely on the Red River domain plunder of natural resources, especially water resources, plundering, looting rate has far exceeded the speed of recovery watershed ecological environment itself, causing the water in the basin has been severely damaged the ecological environment and pollution, declining water, declining water quality, restricted to the sustainable development of the final turn, raise living standards throughout the watershed and social economy. In order to solve the contradiction between water environment and socio-economic development between ecology, the Guizhou provincial government introduced policies and measures for the implementation of the Chishui River basin ecological compensation, in order to balance the interests of the various regions and between upstream and downstream water ecological environment and achieve socio-economic sustainable development.In this paper, the method of empirical research to the Red River basin for the study, a preliminary study on the implementation of the law from the perspective of ecological compensation of the Red River basin. In this paper, three parts, a total of more than thirty-eight thousand words.The first part of this paper is to analyze the ecological compensation and the basic theory of the river basin. Firstly, the concept of ecological compensation is not unified, and the concept of ecological compensation is put forward from theperspective of law through the analysis of the existing research. Secondly, we should to clarify the classification of water ecological compensation of the current complexity. Again, explore the principle and value of ecological compensation in river basin. At last, the theoretical basis of ecological compensation in river basin is discussed, and some basic theories are put forward. In the second part of the paper through the study and Practice on the basis, in-depth analysis and research, to understand the status of the implementation of the Chishui River basin ecological compensation and find out the implementation of legal problems appeared in the process and other related issues. The third part of this paper is aimed at the problems of ecological compensation in the Chishui River Basin, and puts forward the suggestions and Countermeasures of improving the ecological compensation in the Chishui River Basin.
