The Study Of The Environmental Right Of The Peasant

With a series of activities like town enterprise pollution transfer, rural living garbage emissions and farmers mining, rural environment of Poyang Lake wetland is deteriorating,and the environmental rights and interests of the wetland farmers,the vulnerable groups are also violated. In the context of urban and rural development, the research of farmers’ environmental right is particularly urgent.This thesis,taking the Poyang Lake wetland as the object of analysis,using empirical analysis as the main method, display the farmers’ environmental awareness, environmental awareness of rights, the right to participate in the environment,the right to know,right relief,and the right of environmental resources using.Through the analysis, In the present stage of our country current farmers’ environmental awareness is weak, the farmers’ environmental right to know, right to participate, and relief rights, environmental resources using right exists many problems,the realization path of the farmers’ environmental rights is narrow,the protection of farmers’ environmental rights need to be strengthened,and furtherly, I put forward some improving advice of the wetland environmental right protection,and I hope it would be helpful to protect the environment right of the wetland farmers in the furture.This paper is divided into five parts. The first part describes the concept of environment and the environmental right of the farmers. Environmental rights is the right of citizens to enjoy a suitable environment or balanced, healthy environment,and environmental rights of farmers refer to this subject of environmental rights.This part is the basic theory,it is the basic theory to improve the farmers’ right and to protect the environment.The second part is the status of rural environment under the dual trends of urban and rural environment.This section describes the cueernt state of the environment of Poyang Lake wetland countryside,the extent of damage,economic and property losses caused by pollution and health damage,in order to illustrate urgency to protect environmental rights of rural farmers of the Poyang Lake wetland.The third part is the status of Poyang Lake farmers’ awareness and their rights situation of the environment.This section mainly through survey data analyzes the status of the farmers’ environmental awareness and their environmental right awareness.The fourth part describe the main problems in protecting the Poyang Lake wetland farmers’ environmental right in the current situation.Mainly including the problems in protecting farmers’ right to know;the problems in protecting farmers’ right to use the environmental resourse;the problems in participating right of the environment and the problems of the environmental relief.The fifth part is the specific recommendations of improving the environment right of Poyang Lake wetland farmers.Thses proposals include raising awareness of wetland farmers’ right,strengthening the capacity of the farmers’ right,improving environmental public interest litigation system,strengthening environmental monitoring of wetland in rural areas and so on.
