A Study On Legal Regulation Of Pollution Prevention And Control In Tannery Industry

In recent years, tannery pollution incidents were reported by newspapers and various types of media. Especially after the CCTV reported tannery pollution in WUJI county and toxic capsule event, people became more and more concerned about tannery pollution. "Comprehensively advancing rule of law" and implementation of the new "enviromental protection law", put forward new requrements for prevention and control of tannery industry pollution. How to correctly understand tannery industry pollution, how to solve history problems and how to control pollution transfer and expansion become main topices of tannery industry as well as hot topics of economic law.From the legal perspective, this paper adopts empirical analysis, comparative analysis, case analysis and other methods to state the legal regulation and current situation of the prevention and control of tannery industry pollution. According to annalysis of the rights and obligations of enterprises, social organizations, govenment and citizens, this paper points out the reason of tannery industry pollution and defects in legal regulation, and proposes to formulate "Tannery Industry Pollution Prevention and Control Rules" and a series of legal proposals which has filled the blank of reseach of legal regulation of tannery indusry.This paper has five chapters. Chapter One is introduction, which mainly introduced the legal reseach background of tannery industry pollution prevention and control. It also analysizes the structure, innovation points and insufficiency of this paper.Chapter Two states the basic problems of tannery industry pollution prevention and control such as basic concepts and necessity of research. This chapter establishs the scope and object based on clear tannery industry pollution prevention and control concept. It demonstrates the necessity of legal regulation research of tannery industry pollution prevention and control from four aspects: the circulate economy attribute, tannery evergreen, worsening trend and tannery sustainable development.Chapter Three is the current situation of tannery industry pollution prevention and control and legal quesstion. From distribution and harm, cause of formation of pollution in the law and prevention measures and legal quesstions, it analyzes the current situation and provides direction for the study.Chapter Four is the present situation and defects of tannery industry pollution prevention and control. This chapter focuses on the rights and obligations of enterprises, government, social organizations and citizen.Chapter Five, suggestion. This chapter puts forward the basic principles of tannery industry pollution prevention and control, enacting special legal regulation, improving environmental impact assessment system, developing public interest litigation, establishing punitive compensation system and so on.Chapter Six, conclusions.
