Study On Protection Mechanism Of Rights And Interests Related To Construction Migrate Workers’ Industrial Injury

The issue about migrant workers’ compensation has attracted our attention since the emergence of migrant workers groups following the policy of reform and opening up. With the advance of modernization and the acceleration of urbanization, the construction industry has been in the forefront of the national economy. As the main practitioners of the construction industry, their work-related injury rights protection has been a important problem which relates to solving their problems, protecting their legal rights and interests, keeping the stability of society, and promoting the social harmony. However, workers’ compensation rights issue has always risked the survival and development of migrant workers even risked the social harmony and progress. It is due to the non-standard labor and employment system of the construction industry, lack of the necessary labor contracts and work injury insurance for migrant workers with their lack of knowledge, and no relative efforts of the government and social communities.From the perspective of safeguarding the interests of workers’ compensation, this article sums up the experience of work injury treatment and injury rights of home and abroad to open up a new valuable compensation path for the migrant Workers in China. From the concepts of workers’ compensation rights and interests, this article introduces specific workers’ compensation matters and related things of compensation rights and interests of migrant workers, and describes the status quo for workers’ compensation and injury, and summarizes the reasons for workers’ compensation rights problems from aspects of the government, employers, the society and migrant workers. Then, it analyzes the specific cases from the above aspects and summarizes their experience and inadequacies in the process of workers’ compensation. Finally, it is necessary to make strategies for workers’ compensation rights on the basis of the experience and Inadequacies, namely constructing the migrant workers rights protection mechanism that involves the force of the executive, the judicial, the society, and migrant workers individuals, and promoting the improvement of workers’ compensation insurance.
