| Guangxi is a big agricultural province,and tea industry plays an important role in its economic development.It is a labor-intensive industry,and its practitioners are mainly local migrant workers,known as tea garden workers.Due to the characteristics of low recruitment threshold,low remuneration,long field work time and high risk of industrial injury,tea enterprises have a low employment rate of age-appropriate workers and a serious phenomenon of over-age employment.Overage tea garden workers are not covered by industrial injury insurance and lack of industrial injury insurance protection,which is not considered in the current industrial injury insurance policy.Relevant research needs to be carried out from the current situation and policies.As the research object,this paper takes Guangxi Guilin A enterprise by the method of field investigation,A company to look at the tea garden workers work,to grasp the first-hand information,then the tea plantation workers,the questionnaire survey to 150 questionnaires,recycling of 124,effective rate was 80%,in order to further understand the relevant circumstances,to carry out the interview survey,interview object,A total of 18,Among them,there are 3 management personnel and 15 tea garden workers.In this paper,the research content of tea garden workers inductrial injury rights and interests maintenance problems,will be divided into tea plantations of the workers’ rights and interests of inductrial injury to maintain the status quo of inductrial injury insurance purchases,and pay inductrial injury happen,inductrial injury rights maintenance satisfaction three dimensions,discuss the following two questions: First,what problems exist in the protection of industrial injury rights and interests of tea garden workers;Second,how to better safeguard the rights and interests of workers in the tea garden.The investigation results show that there are three main problems in the maintenance of industrial injury rights and interests of tea garden workers in A enterprise in Guilin City;1.The purchase of work-related injury insurance is not ideal;2.the incidence of industrial injury is not low,but the industrial injury private wind prevails;3.Tea garden workers’ satisfaction with the maintenance of work-related injury rights is low.Through research and analysis,the following conclusions are drawn: This paper believes that the problems existing in the protection of industrial injury rights and interests of tea garden workers in enterprise A in Guilin City are caused by the combined action of multiple factors.First,at the national level:The current system of industrial injury insurance has not been able to adapt to the needs of the development of the era,the coverage of industrial injury insurance has blind areas,resulting in overage tea garden workers can not get the protection of industrial injury insurance system,meanwhile,in the implementation process of industrial injury insurance system,the supervision department law enforcement is not strict to reduce the purchase rate of industrial injury insurance for the tea garden workers of the right age,and the relevant departments for the insufficient promotion of industrial injury insurance policy,it further reduces the purchase rate of work-related injury insurance for tea plantation workers of appropriate age.Secondly,from the enterprise level: Enterprise A in Guilin City lacks good management,which leads to the lack of industrial injury insurance and safety protection measures for tea plantation workers.Finally,from the perspective of workers: the tea plantation workers of Enterprise A in Guilin City have a weak awareness of protecting their rights to industrial injury,so they cannot use legal weapons to protect their rights to industrial injury when suffering from industrial injury.Only a very few tea plantation workers choose to protect part of their rights to industrial injury through private work injury.Based on the above conclusions,this paper puts forward countermeasures from three levels: 1.At the national level: The first,strengthen the publicity of work-related injury insurance and improve the way of publicity;The second,implement the supervision and collection responsibility of the relevant departments for A enterprises in Guilin City;The third,expand the coverage of work-related injury insurance and improve supporting policies.2.Enterprise level: The first,standardize the employment of A enterprises in Guilin City and clarify the employment relationship;The second,classification guarantee to improve the satisfaction of the maintenance of industrial injury rights and interests of the tea garden workers of A enterprises in Guilin City;The third,improve the work injury prevention measures of A enterprises in Guilin City.3.At the worker level: The first,improve the awareness of industrial injury protection;The second,establish the awareness of production safety. |
