Research On Protection Of The Rights And Interests Of Migrant Workers In The Process Of Urbanization

Based on the process of urbanization in China and the flow of migrant workers, combined with the actuality of DongGuan, this article focuses on the rights and interests of migrant workers labor protection. And this article is divided into three major parts: the first part is the first charpter , which pays much attention to China's urbanization process and the profile of the flow of migrant workers, and gives a brief of of DongGuan in the aspect of urbanization and flow of migrant workers. Since the founding of New China, China's urbanization development has gone through four periods: from 1949 to 1957 period of restoration and redevelopment, from 1957 to 1965 period of ups and downs, from 1966 to 1978 period of stagnation, from 1979 to 2002 period of steady development of urbanization ; As China's urbanization process, China's flows of migrant workers has also gone through three stages: before 1978 migrant workers are subject to strict restrictions on the movement, since 1980 the movement recover and develop, as well as the quick movement of 1990s; In addition, the city of Dongguan process of urbanization meets china's reform and opening up. Massive influx of migrant workers promote the process of urbanization in Dongguan, and Dongguan adopts an open attitude to the movement of migrant workers.The second part includes Chapters II and III, which, in a brief summary of active roles of migrant workers , introduces the process of working to protect labor rights of migrant workers facing problems and put forward countermeasures. That words lays the foundation for Study the case of Dongguan. The protection of migrant workers rights facing the universality of the main issues, including restrictions of recruiting migrant workers in employment, irregularities in the management of migrant workers, as well as migrant workers's knowing little about basic social security. Migrant peasant workers being marginalized is mainly due to two things: firstly, discriminatory provisions in the management and protection policies of migrant workers, and the other is migrant workers of their own quality to be further enhanced. To solve the problem of migrant workers, in itself a solution to the problem of farmers, this paper gives some suggestion: in the aspect of settlement of urbanization In the process of the process of farmers who lost their land and became to the employment of workers, firstly, establish and improve coverage of migrant workers cross-regional flow of migrant labor service system, and the other is the implementation of labor skills training, to increase the employment rate of migrant workers; in the aspect settlement of migrant farmers Workers lack basic social security issues, the solution is to give national treatment to migrant workers, and the other is to reform and improve the social security of migrant workers, thirdly, to expand funding sources and establish personal accounts to ensure that its national are within the framework of the transferability ,and fourthly, establish and improve relevant laws and regulations, strengthening law enforcement.The third part is Chapter four. Based on the study of case of the city of Dongguan, this part proposes establishment of new mechanisms to improve protection of the rights of migrant workers. Dongguan's migrant workers labor protection of the interests of the major problems include the following aspects: firstly, business managers have a poor awareness of labor laws, which has led to violations of the legitimate rights and interests of migrant workers occur and secondly, migrant workers do not have a strong sense of self-help, The third is shortage of forces to monitor the enforcement of labor force; the new mechanism ,which taken by Dongguan to protect the rights and interests of migrant workers labor rights ,has the following main elements: First, to make China's labor laws and regulations more Perfect, to protect the right to open relief channels, and the other is the establishment of the association of farmers, by which migrant workers in accordance with the law to safeguard the legitimate Labor rights, and the third is to strengthen the monitoring of the administrative work of law enforcement to clamp down on illegal employment strokes, and the last one is to strengthen the law popularization of education and legal aid work to enhance their awareness of the law.
