The Improvement And Simulation Practice Of The Auxiliary Trial System Based On Practicability

For thousand years or more people never stop focusing on the fairness of the judgment on contentious cases. The sense of rights and obligation of human beings or organizations becomes stronger and stronger with the development of the society. Meanwhile, more and more contentious cases for these kinds of conflicts and disputes appeared with various types. Though judicial organs with a representation of the court tried many ways to solve those problems, many contentious cases of unjust, false or wrong charges and unfair trial inevitably occurred all the time.Therefore, the Auxiliary Trial System on the basis of computer network technology appears. It brings hope to people for its appearance as well as disappointment for its application status. The Auxiliary Trial System with the representation of Auxiliary Sentencing System based on criminal law improves the fairness and justice. However, many people still doubt about it due to the limitation of current computer network technology.This thesis began with the applicability by analyzing of the judicial process related to the trial and the principle requirements of the Auxiliary Trial System, explaining its general designation. Then, it demonstrated its development tools, development feasibility, system requirement and safety by pictures, examples and tables. Finally, it showed the outline of the development procedure of the Auxiliary Trial System from the bottom to the top level by using flow charts, flow description, codes and etc.This thesis focused on the study of how the Auxiliary Trial System guarantees the autonomy of the judex. It developed a new Auxiliary Trial System based on practicability by improving the existing one and combining the theory of Standardized Measurement of Penalty.The operation effect of the Auxiliary Trial System met the designation requirement by simulation practice, which will improve the fairness and justice of the judgment on contentious cases and pave the way of standardized measurement of penalty.
