The21th century is the age of information. The computer science has beingdeveloping rapidly and has been applied more widely in each domain of social life.With the development of computer technology and E-government, E-file has emergedas the tomes require, so the resulting topic about a-file management has become anunchangeable trend. As the legal safeguard of e-file management, the construction oflaws and regulation is not only core subject of national strategy of e-life managementbut also the important for other kinds of laws and regulations.With the development of e-government and e-file management adopting theinternational practices, the foreign management experience is brought in china,especially USA’s e-file management that provided some references for Chinese e-filemanagement. Compared with the USA, the construction of laws on the e-filemanagement in china exist many problems such as the less advanced constructionlevel, the flutiness system construction and so on that go against the development ofe-file management and archives information. So it is urgent to use the relative theoriesof e-file management and archives information combined the problems found in themanagement practices to construct the law and regulation system.In this research, collect widely and analyze the domestic and foreign researchresults; integrate the Chinese and USA’s e-file management features, and take thestatus of Chinese e-file management as research background, compare and analyze thedifferences between the USA’s and Chinese from such aspects that are managementconcepts, laws and criterion on archives, laws and regulations on protection and lawsand regulations on utility, and then analyze the problems existing in the constructionof e-file management. For example, legislation is still in the primary stage; the systemis imperfect; the total quantity is less especially the specialized regulations; thecontents of regulation mainly involve the traditional files management or generalinformation management; and the contents are ambiguous and are not renewed timely;and the supporting system is short. Conclude the experiences about e-file management,and finally make some revelations and suggestions in order to perfect the constructionof e-file management.
