Legal Status In The Assembly On Behalf Of University Faculty And Operation Mechanism

Continuous practice with the idea of running in accordance with the law, the basic form of lawful participation in the school democratic management and democratic supervision as faculty members, the staff delegates congress (hereinafter referred to as the Representative Assembly) in the Colleges and universities plays an irreplaceable role in internal affairs such as decision-making and policy implementation. The Representative Assembly is not only the need for the improvement of the governance structure, but also the effective realization of the basic system and safeguards the legitimate rights and interests of the majority of teaching staff in colleges and universities, which also has its increasingly prominent role in the modern colleges and universities system. In the present situation the Representative Assembly can not fully adapt to the development of the existing education system, and rising problems and challenges lie in the lack of internal democratic supervision in colleges and universities. As a result, the Representative Assembly in Colleges should be based on the existing problems in the self-running process to analyze its causes and continue to achieve the improvement of the operating mechanism of Chinese Universities Representative Assembly following the law of development of higher education.With the above review, this thesis attempts to discuss the legal status and operational mechanism of the Representative Assembly in colleges and universities in China. The author takes literature review systematically and in-depth empirical analysis of China’s Representative Assembly in colleges and universities so as to state its legal status, and discuss on how to reconstruct its operational mechanism based on the present situation in the following aspects.First of all, the author takes literature review on the history, concept, features, functions of the Representative Assemble in colleges and universities. With inductive analysis, the author makes conclusion that the representative assembly is an important organization for the college staffs to exercise the rights of the democratic management and supervision, featuring its clear guiding ideology, complete specification of the institution, and being pragmatic and authority. Besides it can help safeguard the legitimate rights and interests of the faculty members, and facilitate faculty members with wide participation in the democratic management and supervision so as to effectively promote the democracy of management, democratic appraisal of leading cadres. The development of the faculty self-management is also traced in universities of foreign countries.Second, through a combination of theory and practice analysis, the thesis discusses the legal status of the staff representative assembly in China’s colleges and universities, based on legal connotation and characteristics of the staff delegates congress, the formulation of the sources of law, and a review of the changing legal status, the interests of the configuration of the staff delegates congress in colleges and universities and its legal relationship with the colleges and universities.Again, the author literally reviews the concept of the staff delegates congress in colleges’operating mechanism. The basic characteristics and goal orientation were analyzed and discussed. Empirical research and analysis are carried out in some colleges and universities in Shaanxi Province. The problems are pointed out concerning the Chinese Universities Representative Assembly. On the basis of summing up their union Chairman/Deputy Chairman interviews, analysis of the causes of the problem, and thus the staff delegates congress is definitely required to set up and needs further to be improved and reformed.Finally, the thesis suggests it is necessary to improve the consciousness of the modern colleges and universities system and improve internal governance structure of the colleges and universities and gradually improve the faculty’s awareness of democracy and foreign universities Representative Assembly operating mechanism reference realistic basis for Improvement of Undergraduate. The staff delegates congress the operating mechanism, put forward countermeasures and suggestions in order to provide the necessary theoretical reference for further reform of College Teacher’s Congress and optimization, to improve the level of management of universities.
