For a long time, our government has been in the strict control of guns out of concernfor social security. From On the Confiscated Illegal Guns and Ammunition to Strengthenthe Management of Guns Circular issued by Ministry of Public Security in1994to TheNotice on Strengthening the Safety Management in the Cutting Tool(Draft) issued byGuang Zhou government in2009and The Notice on Strengthening the Safety Managementin the Cutting Tool of the Municipal Government issued by Shanghai government in2010,we are not difficult to see that our government is more and more severe to gun control andthe scope of control is becoming wider and wider. At the same time, people are thinkingthat how much inevitable connection exists between the strict gun control and the socialorder, where is the power of government for gun control from, whether citizens have theright to self-defense in the face of all kinds of danger and how much right there is.This thesis expounds the citizens’ innate rights to self-defense and resistance from theperspective of human rights and civil rights. On the basis of analyzing the condition of thelegislation and implementation of foreign citizens’ rights to bear arms, this thesis alsoestablishes the argument that the right to bear arms is due to every citizen.
