Medical liability insurance is just to meet the needs ofmedical activities of the dispersing risk.However, from the current situation of the implementation of medical liabilityinsurance, take the way of voluntary insurance completely can not achieve the desiredeffect. Fewer and fewer hospitals take for medical liability insurance. The market ofthe medical liability insurance is obviously inadequate. The nervous of thedoctor-patient relationship has not improved. In this case, Beijing, Shenzhen andHainan and other parts in China started to build regional compulsory medical liabilityinsurance and obtained certain achievements. The practice of compulsory medicalliability insurance increased the demand of medical liability insurance in theseregional, effectively handle the doctor-patient dispute and ease the doctor-patientrelationship. Developed countries generally subject to compulsory medical liabilityinsurance system to spread the risk of medical practice and effectively protect theinterests of the injured in the medical activities. It has greatly promote thedevelopment of the national medical liability insurance. To build China’s compulsorymedical liability insurance system is imminent.In this paper, comparative analysis and empirical analysis was used to analyzethe present situation of the implementation of the medical liability insurance in ourcountry, the main problems and the necessity and feasibility of construction ofcompulsory medical liability insurance in our country. And combined with the actualconditions of our country, hope to give advice to the construction of compulsorymedical liability insurance system in China. Hope for the construction of compulsorymedical liability insurance system of our country contribution meager strength.
