| Since the United States became an independent nation, the American consular protection has been innovating and improving the nation’s development progression. After the Cold War, there was a great opportunity which was provided during the end of the Soviet-American confrontation and the great innovation of information technology for accelerating development of globalization. There were no more boundaries for wares, capital, information and people to circulate worldwide. More and more American citizens as well as corporations have felt the urge to go abroad to seek opportunities through the motivation caused from globalization, thus the need for more consular protection requirements became overwhelming to the American consular protection. In solving this issue, the American consular protection started an important change which focused on two aspects. Firstly, the old approach of consular protection, which was a passive model, has been replaced by a proactive model with prevention mechanism. Secondly, consuls are no longer the only executors in consular protection and services. Other administrations and non-governmental forces are encouraged to put more efforts on expanding the quality of consular protection and services. Recently, the development of the Chinese consular protection has encountered different variations of challenges and changes. These challenges and changes to some extent are similar to those which were met by American consular protection throughout in1990s. For this reason, this thesis will describe in detail the American consular protection and focus on it as an object of study. On one hand, this thesis presents the history of American consular protection by its establishment and innovation, especially the factors leading to the positive outcomes of changes which were happened after the cold war. On the other hand, it makes an analysis of the main flaws and strengths of the American consular protection. At the end of this thesis, by analyzing the differences between the American consular protection and the Chinese one, it attempts a number of constructive proposals for the further improvement of Chinese consular protection. |
