The Research Of Our Country’s Rural Social Security Legal System

Contemporarily, China has been aiming to build an all-round developing andharmonious society, and the development of countryside’s plays an important role.However, rural economic development, social stability, as well as rural comprehensivesustainable development are inseparable from a sound legal system of social security inrural areas. At present, the construction of the legal system of China’s rural socialsecurity has been lagging behind, which has become the weak link in China’s socialsecurity, seriously impeding the progress of the development of the rural economy andrural society, having becoming the bottleneck obstacles of China’s modernization andmarket-oriented reforms. Therefore, based on the actual situation of the rural socialsecurity, establishing a new, more perfect rural social security legal system is the focus ofconstructing socialistic market economy. Speeding up the process of establishing legalsystem of rural social security, adjusting the gap between rich and poor and thedifferences between urban and rural areas through social security system, is thecornerstone of ensuring that society is benignly operated. Adding rural social securityinto the orbit of legal system, not only can provide strong legal supports for countryside,but also it is very much in line with the requirement of comprehensively constructingmoderately prosperous and harmonious society.This paper is divided into five parts. The first part is the introduction. It derives theperspective of this paper mainly by summarizing domestic and foreign scholars relatedresearches.The second part talks about the basic theory of the legal system of China’s ruralsocial security. It mainly describes the connotation of social security, the connotation ofrural social security system and the legal system of the rural social security connotation,and points out the theoretical foundation of China’s new rural social security.The third part mainly studies history and current status of the legal system inChina’s rural social security. By reviewing the course of development of the legal systemof China’s rural social security, objectively examine the status of China’s rural social security legal system, and point out that currently existing in the legal system of China’srural social security deficiencies and propose the necessity and feasibility of theestablishment of rural social security legal system.The fourth part describes the comparison of the legal system of social security inrural areas. By using comparative analysis method, to analyze the rural social securitylegal systems of both developed and developing countries, so as to learn the lesson.The fifth part focuses on how to improve the legal system of China’s rural socialsecurity. Based on knowing the value orientation and the main principles of the legalsystem in China’s rural social security, starting from reality, it proposes suggestions thatare in line with China’s national conditions, it is hoped that it is beneficial for the legalsystem of China’s rural social security.
