To Perfetc The Legal System Of Circular Economy Of China

The development of circular economy is an important strategy for China’s economic andsocial development, an important measure to promote economic structural adjustment and totransform the economic developing modes, as well as a significant way to realize thecoordinate development of environmental protection and economic growth. Since theindustrialization, the development of the world economy grows rapidly, but it also bringsserious environmental problems like environmental pollution. Since the reform and openingup, China’s economic construction has made remarkable achievements, but the extensiveeconomic developing mode for a long term, eventually leads to the resources shortage andenvironmental degradation, and becomes the bottleneck for further development of economicand society. In this context, through the improvement of the legal system of China’s circulareconomy, the thesis expects to be beneficial to the transformation of China’s economicdeveloping mode and to the establishment of sustainable development economic model.The legal system is an important part of the laws and regulations. The legal system of thecircular economy plays a significant role in regulating, guiding, and promoting thedevelopment of circular economy. To establish the legal system of circular economy, thethesis discusses the definition, the principles, and the theoretical basis at first, and then makesfurther interpretation on the nature and its value orientation of the system. Second, the thesisadopts a comparative approach to examine the legal system of circular economy in somewestern developed countries with more mature system and richer experience like Germany,US, and the European Union, and makes a comparison and analysis on China’s six currentlegal systems of the circular economy, especially the Circular Economy Promotion Law. Theexisting problems and its causes are discovered through comparison. Under suchcircumstance, the thesis advocates to improve the legal system of circular economy in Chinafrom three perspectives of principles, contents, and systems. The thesis further puts forwardsthat based on the previous six principles of Circular Economy Promotion Law, the GreenGDP Accounting system, Market Access system, and Public Participation system should beadded as basic principles of circular economy, and take the usage of the recycled water as abasic measure and important content. The perfection of the fundamental theories and legal system of the circular economy would ensure the orderly and healthy development of thecircular economy and realize the harmony of economy, society, and environment.
