| Legal term is an important component of legal language,and its translation exerts adirect influence on the quality of legal translation. Since legal language is the product ofculture, the laws of the countries with different legal cultures have different conceptualstructures, classification rules as well as sources of laws. Therefore, a goodunderstanding of legal cultural discrepancies between China and the west will be helpfulto improve the translation quality of legal terms.The thesis discusses the legal cultural discrepancies between China and the westfrom three aspects of legal institutional structures, legal systems and legalconsciousness, and summarizes how legal cultural discrepancies influence and restrainthe translation of legal terms. On this basis, the thesis, by means of case studies on theEnglish versions of The Criminal Law of the People’s Republic of China and TheCriminal Procedure Law of the People’s Republic of China, probes into the culturalfactors behind the legal terms and puts forward the existing problems caused by legalcultures in translation. For the problems in legal term translation, some suggestions areput forward from the aspects of translators, principles and translation strategies. |
