On The Translation Of Legal Terms From The Background Of The Legal System

Based on the translation of the fourth chapter of the Entrepreneurial Litigation by Professor John C.Coffee,which was published by Harvard University Press in 2015,this article focuses on the translation of legal terms presenting in the book.Entrepreneurial Litigation introduces and evaluates the rise and fall of class litigation in the field of entrepreneurial litigation in the United States.In the process of translation,the author of this article finds that,under the background that Chinese and American laws are in different legal systems,it is difficult to find corresponding Chinese expressions in many legal terms mentioned in the text,and these semantic vacancies are often associated with the unique laws behind the related legal terms.The problems like how to accurately understand the terminology of jurisprudence in the text,how to express the connotation of terms accurately and how to interpret the connotation of legal terminology from the background of specific legal system,etc.are crucial to be resolved in the process of translation.Based on this,this article aims to translate some of the legal terms that appear in the Entrepreneurial Litigation from the background of the legal system.In translating the book,the difficulties of terminology translation can be divided into three aspects,namely the non-equivalence of legal terms in the context under different legal systems;the absence of equivalent terms and polysemy of legal terminology;the phenomenon of semantic loss of the translation of legal terms.The above difficulties can be summed up in three aspects: imperfect competition of legal terms,lack of equivalent legal terms and semantic loss of legal terms.In the attempt to solve the above problems,the author explores and applies three methods to solve the corresponding problems from the point of legal system,namely,cross-references of terminology translation,creation of new words and semantic amplification.
