Study On Improving Legislation Of Rural Environmental Protection

China’s current laws and regulations on environmental protection in rural areas have following shortcomings:First, the guiding ideology of China’s rural environmental protection legislation has not yet been integrated into the concept of scientific development concept, the existing laws in many terms have highlighted the city’s environmental protection, but put little emphasis on environmental governance in rural areas; Secondly, the rural environmental protection still exists defects, omissions and gaps. the existing system has not been able to combine rural environment, agriculture,natural resources,environmental protection and agricultural coordinated; thirdly, the existing legislation did not meet the reality in rural areas,lack of maneuverability in practice, and the rights and obligations is unreasonable, resulting in farmers’ interests have not been fully protected.China’s current laws and regulations on environmental protection in rural areas have following shortcomings:First, the guiding ideology of China’s rural environmental protection legislation has not yet been integrated into the concept of scientific development concept, the existing laws in many terms have highlighted the city’s environmental protection, but put little emphasis on environmental governance in rural areas; Secondly, the rural environmental protection still exists defects, omissions and gaps, the existing system has not been able to combine rural environment, agriculture,natural resources,environmental protection and agricultural coordinated; thirdly, the existing legislation did not meet the reality in rural areas,lack of maneuverability in practice, and the rights and obligations is unreasonable, resulting in farmers’ interests have not been fully protected.Combined with the development trend of rural urbanization and urban-rural integration, the strengthening of rural environmental protection legislation should be based on the existing legal framework, the concept of scientific development concept should be put into legislation guiding ideology, highlighting the protection of the rural environment, improve the enthusiasm of government and farmers, clear legal responsibility when undermine the rural environment, increase the punishment, through the green agricultural subsidy system, improve rural cooperative organizations, local governments and farmers’ organizations’enthusiasm, offer a new direction for the better protection of the rural environment from the legislative level.
