On Environmental Protection Legislation In Guangzhou

As part of local legislation,Guangzhou's environmental protection legislation is related to the advancement of environmental pollution control in Guangzhou and directly affects the construction of the rule of law in Guangzhou.Taking the 18 effective environmental protection regulations in Guangzhou as a sample,through the analysis of the situation of formulation,revision,abolition,and the content of each regulation,on the one hand,Guangzhou environmental protection legislation has a comprehensive scope of environmental legislation and regulations.Comparing with other cities,the amendments and abolitions are more timely,the legislative content is more legal,reasonable,normative,and the public participation in the legislation is higher.However,there are also problems,such as lack of special legislation for ecological progress,blemish of legality,restrictive provision and so on.In addition,local legislation should highlight regional and operability has become the consensus of academic and practical circles,like most provinces and cities.At present,Guangzhou environmental protection legislation has not been able to resolve these two major ills.Therefore,and the Guangzhou legislature still needs to overcome the deficiencies on the basis of the existing achievements.Learning from the useful experience of other provinces and cities in environmental protection legislation,it should further implements the concept of “environmental justice” in environmental protection legislation and promotes special legislation on ecological civilization construction.It is also important to repair legality supplementing prohibition regulations,restrictive regulations,timely revision of laws as well as regulations,and highlights the degree of locality and enhancing operability on the basis of tapping local needs of local environment,with a legislative view to ensure the smooth development of environmental pollution control and resource protection in Guangzhou.
