A Study On The Legal Countermeasures Of Wetland Ecological Protection In China

In the whole earth’s ecosystems, wetland is the most important part of it. Wetlandpurification of life on the earth system has a huge role, the vast majority of waterfowlbreeding and growth cannot leave the wetlands. Many environmental awareness is moreadvanced countries have begun to attach importance to the wetland, by establishing thesystem of environmental protection law of the protection of the wetland to classify. China isone of the natural wetlands area is the fourth largest country in the world, but becauseChinese large population, rapid industrialisation, the dependence of the wetlandenvironment. Today in China is facing the current situation of the degeneration of wetland,the wetland area is shrinking rapidly, lack of legal system to protect the wetland ecosystemdirectly related to the system, the separate legislation of wetland protection needs to beadded, so to develop and perfect our country’s existing wetland protection legal system andlegal system is imminent.In this article, through the application of relevant principle of law science, ecology andeconomics, the analysis of law, environmental ethics, methods such as system theory, thesystematic research on the legal issues of wetland protection in China. The full text isdivided into five parts: the first part illustrates the purpose and significance of this study.The second part discusses the basic theory of wetland ecological protection law.The thirdpart analyzes the existing wetland protection legislation at home and abroad, and studiedthe current situation of Chinese execution of the convention on wetlands and local wetlandlegal policy.The fourth part investigates the present condition of DongPing Lake wetland,analyzed the social cause of the wetland degradation and the rule of law. Although China isa huge country wetland, wetland ecological degradation is serious, need to improve andstrengthen the legal protection, a reasonable and orderly, adjust measures to localconditions to develop. In order to provide the useful suggestions for enacting and perfectingthe speciallaw of wetland protection in China, the author expounded the issues relate to theprotection and legislation of wetland resource from the aspects of choice of the order of law,the model of legislation, legislative justification range, legislative purposesand principles,and the perfection of law.
