With economic development, the environment that people are dependent on isthreatened, and environmental problems are increasingly serious, which may inducepolitical issues. To provide a better development environment for future generations,many countries vigorously change economic development model, develop low-carboneconomy, and adhere to the way of sustainable development, trying to alleviate thegreenhouse effect. The international community made positive efforts to explore acarbon emissions trading system, which needs scientifically determine the carbonemissions during a certain period, rationally allocate initial quota, control total carbonemissions with low abatement costs by market-based instruments, in order to achievethe optimal allocation of resources of environmental capacity.With the calls for environmental protection and sustainable development rising,China faces enormous international pressure, as a big country of the total carbonemissions. At the same time, China’s economy is in a stage of rapid development,which means many industries have a huge potential for carbon reduction. The carbonemissions trading system has been a good development in the United States,theEuropean Union, Japan, Australia and so on, while China’s carbon emissions tradingsystem just started on. As a responsible big country, China will accelerate theestablishment of a carbon emissions trading system in order to set up a goodinternational image and enhance the international competitiveness of China.Firstly, there is an overview of the theory of carbon emissions trading system, adefinition of the legal attribute of the emissions trading. Secondly, this article tries todescribe systems of carbon emissions trading of some countries with a successfulpractice, evaluate them, and learn the merits, some of which may contribute to thedevelopment of China’s carbon emissions trading. Then, there is an analysis of thefeasibility and necessity of the construction of China’s carbon emissions tradingsystem from various angles. In the end, there is a proposal of the concept of the legalsystem of China’s carbon emissions trading by analysis and comparison.
