Environmental pollution, global warming is a major problem plagued thesustainable development of the world, has been concerned about this issue as early asthe1972United Nations Conference on Human Environment held. After the meeting,5June each year, the "World Environment Day" will be named a different theme, thetheme for1989is "Global Warning" because industrialization caused a large numberof greenhouse gas emissions, rising temperatures, all mankind The joint efforts ofcarbon dioxide and other greenhouse gas emissions. In this context, the internationalcarbon emissions trading way."Kyoto Protocol" was adopted in1997and took effectin2005, the Protocol provides for three mechanisms of the international carbonemissions trading, open the first international carbon emissions trading.This thesis is divided into five chapters. The first chapter introduces thebackground and significance; second chapter is an overview of the legal system ofcarbon emissions trading, carbon emissions trading concept, classification andexisting theoretical basis; Chapter3presents the international and related countries(regions) carbon emissions trading policy law and practice; fourth chapter discussesChina’s carbon emissions trading related legislation and practice, the problems ofChina’s carbon emissions trading; fifth chapter is on the basis of these studies, learnfrom the experience of international and country (region) carbon emissions tradinglegislation and practice, the combination of the actual operation of the cleanDevelopment Mechanism in China, establish and perfect the legal system of China’scarbon emissions trading recommendations.The conclusions of the paper are: China should formulate relevant laws andregulations of carbon emissions trading, to protect the carbon emissions trading, themain interest to define the object of carbon emissions trading, the establishment of thecarbon emissions trading market supervision and management mechanism to reducegreenhouse gas emissions, protecting mankind’s common environment.
