Research On The Legal System Of Carbon Emissions Trading Under The Background Of Peak Emissions

Nowadays,global warming has become a common problem faced by all countries in the world,and governments of all countries are trying to find effective ways to emit greenhouse gases.Among them,carbon emission trading system is one of the important systems for controlling greenhouse gases.Western developed countries already have a relatively mature market system.As the world’s most populous country,China is also the world’s largest carbon emission country.Therefore,the establishment of carbon emission trading right system and the establishment of carbon emission trading right legal system has become one of the important development goals of China at the present stage.This paper aims to improve relevant laws and regulations of carbon emission trading and specific implementation rules,and try to provide legislative protection for China’s carbon emission trading market.It comprehensively uses historical research,comparative analysis,and the combination of theory and practice to carry out research.This paper starts with peak discharge,firstly combs the research background and purpose of this paper;Then the relevant theoretical basis is explained to provide help for the subsequent analysis of the legal system of carbon emissions under the background of peak emissions.Article mainly discusses the current situation of carbon emissions trading legal system in our country were analyzed,and found deal subject scope narrow,quota allocation rules and standards of different problems,and on the foreign legal system of carbon emissions were analyzed,and analyses the legal system of the European Union,the United States,Japan’s carbon emissions,to perfect the legal system of carbon emissions at the present stage in China.Finally,the author puts forward corresponding strategies to improve the existing problems of the legal system of carbon emission trading,such as determining the subject of carbon emission trading in China and rationally planning the quota allocation standard,which is conducive to the smooth development of carbon emission trading in China.
