The Study On Hainan Wild Plant Conservation Legal System

Hainan Island is located in the north of the tropics, its unique geography and climate bred very rich wild plant resources.Wild plant resources of Hainan is not only a part of its natural environment,but also an important part which maintains biodiversity in Hainan. With the strategy of development of international tourism island, Hainan has an important opportunity for development, but we can not go along the old road repeatedly that is "Destruction first, treatment later"just for the immediate economic benefits.Therefore, in the development of international tourism in Hainan Island,we should focus on the protection of wild plant resources and walk along the road which combined protection with development.It is not only the need to maintain the ecological balance and biodiversity,but also the need to develop sustainably.At present, Hainan wild plant protection work has made great progress, it has built five National Nature Reserves and twenty-nine Provincial Nature Reserves.It has formulated Hainan Provincial key protected wild plant list and Hainan Aquatic Wildlife Conservation list. However,for the imperfect legislative system of wild plants in Hainan, and the shortage of local laws and regulations and the relevant mechanism of the protection of wild plants in Hainan,There is no sufficient legal basis and institutional guarantee for the Protection of Wild Plants in Hainan.lt is one of the important reasons that Hainan wild plant resources protected poorly. Therefore, it is necessary to establish a sound wild plant resources protection regulation from the practical view in Hainan strengthen the local protection of wild plant resources. Based on the present situation of Hainan’s wild plant resources, as well as the status of relevant legislation and implementation,the paper elaborate and analyze the problems in the legal system of protection of wild plant resources in Hainan.Simultaneously, learning from international and domestic legislations of wild plants and combining the features of the Hainan Special Economic Zone, we can put forward proposals to perfect wild plant conservation legal system of Hainan.The article is divided into four parts. In the first part, it elaborates the status of wild plant resources of Hainan and its wild plant conservation legal system. The second part introduces the wild plant protection law of the United States, the United Kingdom and Australia, therefore we can learn advanced concepts and laws which are conducive to protect wild plants. Based on the discussion of the above two parts, the next part proposes some problems which exist in legal system,the scope of protection,public participation mechanism, enforcement power,liability and other system.In the last part,response to these problems,it puts forward some advices to promote wild plant conservation legal system of Hainan.
