Research On Legislation Issues In Prevebting Tne Rural Livestock And Poultry Breeding Pollution Of China

The changes of rural livestock and poultry breeding management from decentralized to intensive and scale mode have caused ineffectively dispose of massive waste which converted to pollutants. With regard to its serious pollution and destruction of rural ecological environment, the effective prevention and control of rural livestock and poultry breeding pollution has important significanc to our social construction and rural environmental protection as well as to the whole world. The protection of farmers’ environmental rights run through the prevention and control of rural livestock and poultry breeding from all aspects. According to the overall train of thought from discover problems, analyze problems to solve problems, by means of theoretical analysis, empirical analysis, legal system and legal cause analysis of the overall research program and based on drawing lessons from foreign relevant legal system of prevention and control of the rural livestock and poultry breeding pollution, this paper puts forward the legal countermeasures and suggestions to solve rural environmental problems of livestock and poultry breeding pollution in China.Firstly, this paper expounds the basic theory of prevention and control of the rural livestock and poultry breeding pollution. It summarizes the contents and types of livestock and poultry breeding pollution in rural areas and defines the connotation and contents of farmers’ environmental rights. In the meantime, it analyzes the theory of risk prevention, the theory of environmental justice and the theory of circulation economic which laid the theoretical foundation of this research.Secondly, this paper investigates the present status of prevention and control of the rural livestock and poultry breeding pollution in China from the empirical angle. Through analyzing the present situation of its legal system and the operation status, it tries to explore the main issues of prevention and control of the rural livestock and poultry breeding pollution which turns out to be lack of adequate governmental supervision on rural breeding producers, frequent environment disputes on rural livestock and poultry breeding pollution and serous disposal from livestock and poultry breeding producers. Based on those problems, the paper analyzes the legal reasons of livestock and poultry breeding pollution prevention in rural areas. Thirdly, this paper introduces the legal system of the typical foreign countries or regions related to prevention and control of rural livestock and poultry breeding pollution. Through the legal system of the United States, Canada, Japan and the European Union, with combination of the actual conditions of prevention and control of rural livestock and poultry breeding pollution, it concludes that our government should actively perform its environmental responsibilities in rural environmental pollution by livestock and poultry breeding, should strengthen the construction of agricultural industry organizations to guide the healthy development of livestock and poultry breeding industry and should promote circular economy in livestock and poultry breeding industry.Finally, this paper explores the legal path and choice of prevention and control of China’s rural livestock and poultry breeding pollution. From perfecting the legislation system and law enforcement system of prevention and control of the rural livestock and poultry breeding pollution, improving the judicial relief syetem of rural environmental infringement and the environmental responsibilities and consciousness of the rural relevant subjects, it puts forward the concrete countermeasures and suggestions to resolve the problems of China’s rural livestock and poultry breeding pollution.
